3WIN3, the technology by My Success LLC

Definitions
"Company" shall mean My Success LLC, the legal
entity who is a party to your Basic Agreement. The company
is My Success LLC. 3WIN3 is the technology designed, developed
and maintained by My Success LLC. "Site" means
the online network to which you are subscribing or accessing,
either "You", "Subscriber", "Member
User", "User", or "New Representative"
means the person that is accessing or subscribing to the
Site.
Proper Use
By subscribing to or accessing information on the Site,
You expressly agree to abide by and be governed by all applicable
Company policies and procedures on accessing and using this
web site, including, but not limited to the following:
1. Password Security
Each authorized subscriber to the Site will be assigned
his/her password. Passwords may only be used by the person
to whom the password has been issued. Sharing of passwords
with anybody else, including other Representatives, IS NOT
PERMITTED. You are individually responsible for maintaining
the integrity of your password and you will be held accountable
for data accessed with your password. If you become aware
of, or believe there has been, any theft or unauthorized
use of your password, you agree to notify the Company immediately
by notifying the Technical Support Line or customer contact
email listed Info@3win3.com
2. Use of the
Site
The 3WIN3 Referral System is for members only. By using
this Site, you represent and warrant that you are a representative
or member user in good standing with the Company.
Your use of this Site is also governed, as applicable, by
other contractual and company requirements that govern the
conduct of your business, as well as any applicable rules,
regulations or laws. The Company makes no representative
or warranty as to communication interruptions or interceptions
or loss of data, or the absence of viruses or other harmful
components.
3. Confidential
Information
Information on the Site is proprietary information of the
Company and is highly confidential. Some of the information
on the Site constitutes a trade secret of the Company and
is being provided to you for the sole purpose of helping
you build successful referral lists that are trade secrets
and constitute confidential information.
4. Links to Third
Party Websites
This Site may provide links to sites maintained by third
parties. A link does not constitute an endorsement, express
or implied, of the content, viewpoint, accuracy, opinions,
policies, products, services, or accessibility of that web
site. The Company is not liable for any material provided
by a third party on its website even if such material can
be accessed through a link on this Site. You alone will
bear the sole responsibility of evaluating the merits and
risks associated with the access or use of any information
provided by a third party.
5. Monitoring
The Company is not obligated to monitor any submissions
or transmissions to or through this Site or any website
to which this Site links or that links into this Site. The
entire content of the Site may be reviewed and monitored
by the Company for administrative, security and other lawful
purposes. You may be subject to termination of your user
agreements and civil litigation for improper use or other
use contrary to this Use Agreement. In the event of any
conflict between Company policy and local law or regulation,
the local law or regulation will be followed.
6. Privacy
While information is the cornerstone of our ability to provide
superior service, our most important asset is our customer's
trust. Keeping customer information secure and using it
only as our customers would want us to is a top priority
for all of us. Here is our privacy policy:
. We will safeguard, according to strict standards of security
and confidentiality, any information our customers share
with us or enter into the system.
. We will limit the collection and use of information to
the minimum we require to deliver superior service to our
customers, which includes advising our customers about our
products, services and other opportunities in connection
with our service.
. We will not reveal customer information to any external
organization unless we have previously informed the customer
in disclosures or agreements, have been authorized by the
customer, or we are required by law.
. We will always maintain control over the confidentiality
and privacy of our customer's personal information as well
as the information entered into the system by our customers.
7. Confidentiality
and Privacy of the Client Referral Information
We, the company only gather the client referral information
on your behalf, and will not use the information for any
other purpose. The information entered into the system is
secured and password protected in your account. You as a
representative of your company, is obligated to comply with
all company policies and procedures as outlined in the agreement
with your representing company. You are responsible for
the proper use of referral information, therefore, release
us, the company from any damage or claim resulted from any
misuse of the information.
8. Communication
with the general public
You will take all responsibility for all contact, in any
form, with the general public. The Company is not liable
for the content or the method of any communications that
take place between you and the general public, you alone
will bear the sole responsibility of evaluating the merits
and risks associated with communicating with the public.
All Samples within the 3Win3 Referral System that pertain
to communication with the public are ONLY examples and are
not meant as recommendations or suggestions of how you should
communicate with the general public. Any contractual agreements
that govern the conduct of your business, applicable rules,
regulations or laws that exist must be followed by the User
and the Company will NOT be liable or held responsible in
any way for any communications with the general public that
do not adhere these laws.
9. Knowledge
and Experience
Much of the information on the Site has been formulated
using the latest technology and knowledge from top industry
leaders. The result is material that we hope will be helpful
to you in building a referral base. Information on the Site
is not a "directive" or all-inclusive guide telling
you how you "must" build referral base, clientele,
or business, nor does it guarantee the performance of your
business. The only requirement that the Company makes is
that you operate your business within legal and contractual
limits.
10. Service Agreement
At My Success LLC, we have no greater priority than ensuring
that our customers receive the best in technical support.
As a reflection of this commitment, our entire staff is
dedicated to ensuring your satisfaction. If at any time
you have a question, concern or compliment, please contact
us. We want to hear from you. Electronic mail is quick and
easy way to relay your questions, concerns and compliments.

We know how important your time is to
you. If you have any challenges and need assistance the
fastest form of communication is via e-mail at Info@3win3.com
we will answer any questions within 24 -48 hrs. If you need
to call about a technical problem, a Technical Support Representative
will return your call in the order in which it is received
within 3 business days. If your problem cannot be resolved
on the first call, the Technical Support Rep will refer
your call to a technician for a callback, usually within
two business days from the time of your call. If we are
unable to reach you after two calls, we will leave a message,
if possible, and then wait for your callback.
11. Support Policy
We are committed to supporting our software on all working
systems that meet our minimum configurations. However, not
all combinations of PCs, printers, modems, and software
are compatible with the some aspects of the 3WIN3 web service.
We are not authorized to make repairs or modifications to
hardware or operating systems. So, if you're planning a
purchase, we encourage you to call us beforehand.
In response to advancements in technology, we will periodically
modify our configuration requirements. As a result, outmoded
technology, like diskettes and dot matrix printers, will
not be supported by the program. It is the user's responsibility
to keep their PC upgraded to the current recommended levels.
By maintaining at least the recommended levels, you will
promote the efficiency of the program and will experience
a more prompt response from your computer when using our
software.
Although the Company does accept orders for systems that
only meet our minimum standards, which are much lower than
our recommended standards, these orders are accepted with
the expectation that the user will soon upgrade their PC
to our recommended standards. If the subscriber has any
problems running the software on a PC below recommended
standards, there will be no refunds of installation or service
fees paid.
12. Service Cancellation
Subscription cancellations must be submitted in writing
via e-mail at Info@3win3.com with the subscriber's contact
information including full name, address, payment method,
and benefit service level when the purchase was made, personalized
ID #, password. Once service is cancelled, the subscriber
will receive a confirmation if they have provided a personal
email address. It is the subscriber's responsibility to
confirm that service has been cancelled. No refunds will
be made if service is not cancelled. Service cancellations
take effect on the last day of the month for which service
has been paid.
We reserve the right to cancel your service for the following
reasons:
- Returned Checks ($20 [$35 Can] fee will be assessed for
returned checks)
- Fraudulent or Improper Use deemed by the company (Any
usage that is not in compliance with this Use Agreement)
- Level 3 - RVP/Advanced Builder Request
13. Service Upgrades
and Pricing
Any Level 2 User who advances to the position of RVP will
automatically be upgraded to a Level 3 User fee schedule
and will receive the benefits of Level 3 - Advanced Builder/RVP.
Any Level 1 User whose 60 day free trial period has expired
will have an additional 60 days to upgrade their service
level to at least a Level 2 at which time any referral information
they entered into the system will be restored to their account.
If the Level 1 User does not upgrade their service within
this time period then the referral information will be permanently
deleted from the system.
We reserve the rights to increase or decrease the pricing
for all Levels of User's that are using the system at any
time. These price updates can be seen clearly on the Website
under Features and Benefits/ Benefits.
14. Payment Information
You are responsible for all payment information entered
in the system upon Sign Up, Update or Upgrade, by entering
the information you are verifying its veracity and truthfulness.
Any fraudulent use of payment information by the User will
fall under State and/or Federal laws and regulations. All
information entered into the system by the User is the User's
responsibility solely and in no way connected to the Company.
15. Automatic
Disconnection
Any subscriber who has a balance (3 day overall due) due
on the 1st day of any month will have the service automatically
disconnected. Service can be reconnected by logging into
the Site and using a credit card or by mailing a check or
money order to the Billing Department for the amount due.
16. Initial Password
After the initial password reset users will be issued a
temporary password and they will be prompted to change their
password immediately within the system. User IDs and passwords
should be kept confidential and should never be shared.

you enter the Site.
